On September 30th, California Governor Gavin Newsom signed Assembly Bill 2762 into law. This law prohibits the sale and manufacture of personal care products and cosmetics with certain harmful ingredients in the state of California.

For those of us who are interested in finding better products with absolutely no harsh toxins, you have to be diligent and educated. It’s not easy to memorize which harmful ingredients to watch out for, especially when there can be different names for just one ingredient, making in that much more confusing. However, now that A.B. 2762 was passed into California law, shopping for Californian’s just got that much easier. The Toxic-Free Cosmetics Act is the first state in the nation to ban 24 damaging ingredients.

What Does This Look Like?:
This specific bill bans 24 chemicals including phthalates, parabens, mercury, multiple types of formaldehyde, and PFAS from all personal care items and cosmetics, which have all been questioned for years by many eco-retailers and members of the EWG. The Toxic-Free Cosmetics Act also ensures that by 2025 24 chemicals will be outlawed. All of these ingredients are linked to cancer, reproductive harm, and the disruption of hormones. However, this isn’t new information, as the European Union has prohibited these exact ingredients for quite some time.

For any clean beauty enthusiast, this is a huge milestone. The beauty industry in the United States is infamously under-regulated. Ingredients continue to be used by major companies well after they’ve been documented and shown to be unsafe.

Under this new law, personal care items are prohibited from including any of the ingredients listed above. And according to Senior Advocate for California Government Affairs, Susan Little , this law also allows the attorney general of California to require the termination of sale of products that contain any of these ingredients that are currently on shelves or being produced.

Where Do We Go From Here?:
As for the rest of the country? Multiple proposals are awaiting Congress that would enhance the wellbeing and safety of personal care products throughout the United States. We have to remember that the last time there was any regulation regarding ingredient restrictions it was in 1938. Until then, if you’re not located in California, please remain vigilant about the ingredients in your products. It’s still on us to do the heavy lifting until more laws get passed.
